View Full Version : Should Bashir be arrested?
MrUniteUs 02-Apr-09, 13:49 Should Bashir be arrested?
Yeah, when G.W Bush is arrested.
Yeah, when G.W Bush is arrested.
You mean in tandem or the weaker first then the stronger??????/
Should Bashir be arrested?
based on what charges?
He shouldn't
No, because it is not his fault. All the countries in that region has these problems but Sudan due to its size and ethnic diversity was a much tougher case. These societies have not been able to create a national identity. Even Chad has civil war. But the British were somewhat responsible for this mess. But Bashir should not be blamed for this problem which he inherited and he himself is not sophisticated enough to handle this. But then again very few leaders in Africa are, the continent is filled with civil war.

ِFor all kind of charges of miss use of authorty againnst his own people from thift to killing except homosexuality.

There is a big difference between civil war and slaughterhouse. The 200.000 death people were noncombattants. The chief-in-command is to blame.
how about I give you real figure in 2008 1500 were killed due to violence in darfur, according to unamid, its hardly a massacre, and most of them were combatants, there is no proof that the army has commited any crimes or been orderd to commit any crimes, but it doesnt stop a politically motivated court from charge the president.
Should Bashir be arrested?
NO he shouldn't for a very good reason; he didn't order killings of a certain tribe / people . race...he was only trying to solve an already existing problem by supporting one side and calling the other outlaws...where is the crime?
Big No -- Only when he is found guilty of the crimes by the international criminal court judges. other than fair and just persecution, Bashir should not be arrested.however, doing so without proper procedure according to the law would not convine Bashir sysmpathizers and supporters around the world.it would likely spark more criticism and furry among nations. arresting him anyhowly , would be an abortion of justices and power abuse by the international court or by whoever catch him.
Mr al Bashir deserve fairness in the eyes of laws, but not forgiveness from his victims anf the law. all his rights as human being should be given to him at all levels.
No, he shouldnt be arrested...but he should resign. Same way that Thabo Mbeki resigned...after a judge hinted at political interference (in the judicial process) by Mbeki. Al Bashir gave us some semblence of peace in the South, and for that I am very grateful. However, he has failed to bring peace to Darfur. he is unelected and he should go.
SGravanno 02-Apr-09, 21:40 Suppose he is arrested overnight and shipped to the Netherland, who will take over the presidency in khartoum? Salva Kiir or Ali Osman Mohd Taha? Assuming this transition took place in favor of Salva Kiir, how will it resonate with the fact the consititution grant SPLM 28% of national power and 52% to NCP? Any one ever wonder about that?

Constitutionally this question is unambiguous.. the Presidency is for the NCP in the interim period! The 1st VP is for the SPLM. No one can be promoted or demoted into a higher or lower office.
In the event the seat is vacated the position belongs to the Chairman/women of the Party concerned with that office.
So relax and take it easy no one will spoil the “plan”
Yes! he should...Omer Albashir should be arrested immediately.
A guy here is talking about 1500 people killed in 2008....
We are NOT talking about 2008...We are talking about the murder and slaughter of more than 300.000 people. Civilians who died through the aggression of the Sudanese Army and their Janjaweed allies. We are talking about those who died due to disease and malnutrition BECAUSE Omer Albashir gave orders to kill and rape.
We are talking about more than 300.000 people who suffered from Bashir and the greedy, brutal regime since 2003
Mr Holmes the under-Secretary-General for Humanitarian Affairs and Emergency Relief Coordinator said that 300,000 was a conservative figure.
In my own view based on many mortality assessments, looking at all the data that I can put my hands on the figure is likely to be closer to 500,000," he said.
Unbelievable more than 300.000 dead people and democratic societies are still discussing:angry: In my opinion the NATO should intervene immediately and force the sudanese army and their allies back into their barracks.

Moller were all very aware that you would like to see al bashir removed regardless of the method, like many of the supporters of the ICC this is nothing about Darfur, but settling an old score with the NCP.You propose bashir be held responsible for all darfurs deaths regardless of whether those people died of natural causes or whether they would have died even if the rebels hadnt started the conflict in Darfur, and you choose to totally ignore totaly the role of the rebels in this conflict. The sudanese government has acted legitametly against forieghn backed insurgents in protection of sudans soverighnty and has only targeted those responsible for the instability in sudan. The fact that you will support a foreighn invasion of our country shows how much of a low life traitor you are.
Should Bashir be arrested?
Definitely. He should be arrested for all the crime that he have committed. I have seen people here tried to say that there is no evident that the war crime has been committed. Uuuuuh! what a lies. War plane pilot have testify that he was jailed for refusing to bombed the civillians. Many people who witness the murder of their loves ones have testify that it was sudan army who killed them and raped some. if people like this testified, what other evident do we need? Bashir is guilty and must face his crime.

You have nothing to do with Sudan, so get out of here.

ِFor all kind of charges of miss use of authorty againnst his own people from thift to killing except homosexuality.
Yeah because the "hadith" said it should be under the table and no one should talk about it, but if they do, make sure you kill them. We don't wanna lost more live, so we will leave that one out for now.
Bashir should resign. A new government must be put in place but before that there must bge a constitution. How can you have a proper constitution when there is still debate about the role religion plays in government? Most Sudanese are Sunnis, so how are you going to convince them that the government should not impose religion on people if they believe Islam is also a legal and political entity? They have something called Shariah law, they believe it is Islamic and was ordered by the prophet and God.
Meanwhile the SPLA is also tribalistic and corrupt and would end up governing like most Africa countries. Sooner or later they would be another civil war in the South this time against the SPLA government. Right now most of the southerners have a common enemy, the Arab and Muslim north and their domination of their lives. But once that goes away, they would not find it easy to unite. There needs to be a way for us to start a debate about Islam. People here who think by attacking Muhammad and insulting him the Muslims would abandon Islam and apostate are bing careless and are helping the Islamist and Sunni establishment. A better way is to create allainces with Islamic reformist and helping them propagate their message. Most Southern intellectuals are Christians and they have inherited the rivalry mentality where they see themselves in an never ending rivalry with Islam and Muhammad. They are not achieving anything but making Muslims feel they are hated and victimized. They have also inherited the hypocrysy of Christianity where they attack other religions and insult other religions while they go along and commit crimes.
Support the Koranist, it is better for all of you. The Koran guarantees freedom and has no quarrels with secularism and at the same time the Koran has authority with Muslims and can easily push away Sunnism out of the picture or at least limit its influence. But leaving Muslims with the option of either you remain Sunni or you apostate from islam is very reckless and carelss. Its not realistic to expect them to apostate.
Insisting on attacking the Koran even if there is no real reason to except "I am a Christian and I am programmed to attack Islam and anything that symbolizes it and my people have suffered under these people who call themselves Muslims and Arabs therefore I hate them" is not responsible and counter productive.
Just my 2 cents.
He should be questioned to clarify these charges and proves innocent or not

could a court that picks its cases on politics, expect to come to a desition that isnt political, omar al bashir does not and will not answer to the west
SGravanno 03-Apr-09, 11:16 Darfuri !
You are dead right on the sands of western Sudan. The interim constitution specified who will take over of the presidency in the event it is vacated by the incumbent president in article 2.3.5 of the power sharing clause but it also contradicts itself in article 2.3.8 where it clearly state in the event of that post fall vacant, the presidential council should assume the function of the president until they agree on a nominee which could either be the FVP, the 2nd FVP or the Speaker of the National Assembly. Tell me that's not ambiguous!

Al-Basheer maybe responsible for some million dead people. Unfortunately the war crimes in south Sudan are not on the agenda of ICC.
In my opinion the sudanese people should investigate his crimes.

How many noncombattants were killed 2007? 2006? 2005? 2004? How many women werer raped in this years?

even the politically motivated ICC aknowledges that those killed in Darfur do not exceed 35000.

Yes,but who actually killed these people, are you still buying these lies from western propaganda .NGOs are merely cheap peddlers in human misery.

Darfuri!? Still you can't relate to politics without tribalism .. we must all be from Drafur to care!?
No, The Council is not discharged with selecting a replacement, but the "function." It is the the NCP and SPLM who should (agree to select) if one of their allotted posts becomes vacant. When Dr. Garang passed that what happened … the SPLM Organs selected a replacement and he was confirmed.
Aricle 2.3.5 Power-Sharing “Until such time as elections are held, the current incumbent President (or his successor) shall be the President and Commander-in-Chief of the Sudan Armed Forces {SAF}.”
“The current SPLM Chairman (or his successor) shall be the First Vice President and shall at the same time hold the posts of President of the Government of Southern Sudan (GOSS) and Commander-in-Chief of the Sudan People’s Liberation Army (SPLA).”
Simply stated - the Chairman of the SPLM if he is 1st VP or holds the Presidency of GOSS and is C-in-C of the SPLA is not constitutionally qualified to become National President in the Interim Period.
SGravanno 03-Apr-09, 18:44 Darfuri :lool:
I see you are not constitutional savvy enough to see the ambiguity in the detail. You quoted 2.3.5 in full but not 2.3.8. You also cooked up your own meaning of the council's responsibility which is currently made of both NCP & SPLM and if you like you could add the Minnawi Group as an amendement per the socalled Darfur Peace Agreement in Abuja :lool:But you didn't define its function which is clearly state in article 2.3.8. I'm not saying you were not dead right on 2.3.5 but rather that article contradict itself with 2.3.8. hence the presence of the ambiguity in the entire framework. Are you still breathing?

Okay .. I made it all up!
Yes, Kiir could end up (without being elected and before the interim period ends) as President!
Oh yes .. I also believe in the tooth fairy and Santa Clause!!:-?
SGravanno 03-Apr-09, 19:10 Easy boy, the whole question was hypothetical "what if Al Bashir was arrested overnite," not a real scenario, so don't sweat it. As far I'm concern he ain't going nowhere from power, the Arab League, the African Union and pockets of countries in Far East is all behind him and I don't think he gave a damn about the imperialists in the West that most you seem to percieve as heavan sanctuary. It is all hypothetical, boy!
Caveat: don't ever wake the sleepy lion :lool:

If we were living in an ideal world then the answer would be yes, and not only Bashier but the majority of the Arabs and African leaders, also many leaders of the West and east who supported and aided many of the atrocity in the African continent and else where. The list will be too long and it would include Bush, Toni Blair, Kim Jong-Il, Vladimir Putin, and many more. But since we are not living in ideal world then I would say NO for his arrest. I mean why arrest the weaker of the list and leave the stronger free to roam.
SGravanno 04-Apr-09, 14:22 Hmmmm! the way i see it if both lion and a pig are placed in the same farm, one of them will not survive. :lool:
But if pigs are wise they would not bother to mess with the sleepy lion, am I correct or this is getting too mythical?

what kind of reasoning is this ya Abu Fass?
what kind of reasoning is this ya Abu Fass?
No reasoning is embeded in this saying, My answer to your question is that there are allegations checked in by the ICC to hold as real charges.Al Bashier required to be testified for,if convicted all in all a last one will commensurate with the verdict. His crimes range from thift to abhor killing.
Homosexualty is not included in the charges, so be rested your boss reputation is no yet tarnished.
